In addition to, and to complete the Terms and Conditions, the following additional information is provided

Pursuant to art. 13 of European Regulation 679/2016, this privacy notice describes how Key Automation S.r.l. (“Key”) processes the personal data of Users in relation to the use of the Kube Pro (“Kube”) system, which includes:

  1. a smartphone application reserved for installers and with restricted access (hereinafter referred to as “App”);

  2. hardware devices (hereinafter referred to as “hardware”);

  3. dedicated firmware and software;

  4. the web portal “https://cloud.keyautomation.it” with restricted access (hereinafter referred to as “portal” or “website”).


This privacy notice, which only applies to the website and not to the other websites that may be reached via the links contained in it, is based on Recommendation no. 2/2001 of 17 May 2001, on Opinion no. 04/2012 on Cookie Consent Exemption adopted on 7 June 2012 and on Working Document 02/2013 providing guidance on obtaining consent for cookies adopted on 2 October 2013, which the European authorities for the protection of personal data, gathered in the Group established pursuant to art. 29 of Directive no. 95/46/EC, have adopted with a view to establish minimum requirements for the on-line collection of personal data and specifically the methods, timing and nature of the information that Data Controllers must provide users when they access web-pages, regardless of the purpose of their access.

1. DATA CONTROLLER

The Data Controller is Key Automation S.r.l., with registered office in Italy, San Donà di Piave (VE), 30027, Via Antonio Meucci snc.

Any information relating to the processing of personal data may be addressed to the Data Controller by writing to the following e-mail address: kube@keyautomation.it.

2. CATEGORIES, NATURE AND PURPOSE OF PROCESSED DATA

Key shall process some personal data of Users who interact with the web services of the Website and with the App.

Browsing data

When Users browse the Website, we automatically receive and collect the URL (Uniform Resource Locator) of the website from which the User originates and/or which is accessed by Users when they leave the Website, the IP address (Internet Protocol), the type of operating system and the browser currently used, and if browsing through a mobile device, the identifier of the mobile navigation tool, the operating system used and the name of the ISP (Internet Service Provider) for such device.

These data are solely used to obtain anonymous statistical information about the use of the Website and to check its correct functioning and are immediately deleted after processing.
The data could be used to ascertain liability in the event of computer crimes: subject to the above, data concerning website contacts are not stored for more than seven days.

Data provided by Users

Any message sent to the contacts specified on the Website or through the App involves the acquisition of the e-mail address and other personal data contained in the message.

The subjects or the categories of subjects that, for the purposes described in this privacy notice, could access the data or to whom the data could be disclosed, due to their involvement in the organization of the website, in the development of the App and in the management of the orders, are the internal (administrative and technical) staff specifically appointed as well as external subjects (suppliers of third party technical services, hosting providers, IT companies, insurance companies in relation to any insured risks) which, if necessary, are also appointed as Data Processors by the Data Controller.

Unless it is absolutely necessary, Users are encouraged no to enter any sensitive or judicial data, as this could lead to the destruction or deletion of the messages.

The data processing associated with this web service takes place at the aforementioned registered office and is supervised by the data controller and by the consulting company supporting the former in the maintenance of the website. Any email optionally, explicitly and voluntarily sent to the e-mail addresses listed on this website involves the subsequent acquisition of the sender’s address, which is necessary to reply to the requests, and of any other data included in the message.

Specific privacy notices shall be progressively reported or displayed on web pages dedicated to specific on demand services.

Save for the information provided below for browsing data, users are free to provide the personal data contained in any information request forms. Failure to provide them may make it impossible to fulfil the request.

The consent given may be withdrawn at any time.

Personal data are processed using automated tools for the time strictly necessary to achieve the purposes for which they were collected. Specific security measures are in place to prevent any data loss, unlawful or incorrect use of or unauthorized access to data.


3. COOKIES

Cookies are small text files saved by the Website or by third parties in the internet access device (computer, tablet, mobile phone, etc.) of Website visitors, to be subsequently reproduced in the same Website when the same visitor next visits it. This information may concern the visitor or the device and is mainly used to adapt the functioning of a website to the visitor’s expectations, by offering a more personalised browsing experience and by memorizing the choices previously made.

Analytics
These cookies are used exclusively to collect and analyse statistical information regarding accesses to the Website, in aggregate form. They provide information on how visitors use the Website, so that we can assess and improve its functioning. In this way, we collect information on the browsing quality offered. All information collected by these cookies is anonymous and not associated with visitors’ personal data.

Profiling cookies

They are designed to create profiles of the visitor and are used to send advertising messages in line with the preferences shown during navigation.

Session cookies

These cookies are stored during a browsing session, they expire and are normally deleted at the end of the session. The Website uses session cookies to track the use of the Website during a single browsing session and to facilitate the use of the Website by visitors.

These are cookies of third parties, typically business partners of the Data Controller, that are included, for example, to identify the target, so that the ads that are considered as best matching the interests of visitors are chosen and displayed based on the visitor’s previous activity.

They enable the device to be recognized when it is used to log in again, essentially to help visitors to quickly reconnect to the Website. They are also used by the Website for analytical purposes.

These cookies are saved by the Website to record the movements made by visitors. They are mainly used to manage the Website and to collect data that improve the services offered.

Technical cookies

These cookies are used exclusively to send communications on an electronic communications network, or insofar as it is strictly necessary for the provider of an information society service that has been explicitly requested by the contracting party or user in order to provide the said service.

HOW WE USE THE COOKIES

The Website only uses technical and session cookies. Other types of cookies, or similar technologies, may be used from time to time to enable the Website use or to provide specific functions. Some persistent cookies may be used to trace the language used by the User’s computer system, which in any case can be disabled at any time. For session data and for data strictly necessary to operate the Website, providing the data is necessary and does not require the User’s consent. Failure to provide these data may make it impossible to browse the Website.

Unless otherwise specified, the use of cookies – or of other tracking tools – by the Website, is intended to identify visitors and to record their preferences for purposes that are strictly related to the Website content.

The Website uses persistent and session cookies and other tracking technologies to: (a) store the user name and password; (b) analyse the use of the service and navigation, including to improve content management and access to the Website services; (c) improve the security of the Website.

The Website may contain third-party cookies. HOW CAN I DISABLE COOKIES?

You can affect the transmission of cookies and prevent their installation by modifying the browser configuration in order to block certain types of cookies. In addition, some Website features may not function properly if cookies acceptance is disabled.


4. OPTIONAL PROVISION OF DATA

Notwithstanding the foregoing in relation to navigation data and cookies, Users are free to provide the personal data specified in contacts and/or communications with Key. Failure to provide them may affect the ability to receive replies.


5. PROCESSING METHOD

Personal data are processed using automated tools, according to logics that are strictly related to, and for the time strictly necessary to achieve the purposes for which they were collected.

Personal data shall be collected and processed on both electronic and paper media and shall be recorded in a secure environment, by taking appropriate security measures to reduce the risk of dispersion, loss, including accidental loss, and breach by third parties. In any case, the User acknowledges that providing the data involves a risk of data loss or violation and that the Data Controller, except in cases of wilful misconduct or gross negligence, assumes no liability for the damage that could result from loss or violation of the data provided by the User.


6. SCOPE OF COMMUNICATION AND TRANSFER OF DATA

The personal data shall be processed by Key’s appointed staff and possibly by its professional advisors. The personal data may also be processed by third parties, suppliers of external services (e.g., technical assistance), acting on behalf or in the name of Key, duly appointed as Data Processors or as Persons in Charge of the Processing, and who shall process the data in accordance with the purpose for which the data were originally collected.


7. USER’S RIGHTS

At any time and with no need for special formalities, the data subjects may exercise their rights vis à vis the Data Controller, pursuant to art. 15 and following of Regulation 679/16 EU, specifically to obtain confirmation whether any of their data are being held and to be informed about the content and origin of such data, to verify their accuracy or request their completion, updating, amendment, deletion or to request a limitation on, or object to the processing of their personal data. These articles also provide for the data subjects’ right to contact a supervisory Authority to protect their rights. All these rights can be exercised by writing to: kube@keyautomation.it


8. AMENDMENTS TO THIS PRIVACY POLICY

The Data Controller reserves the right to make changes to this Privacy Policy at any time, by informing the Users on this page. In case of non-acceptance of the amendments made to this Privacy Policy, Users are required to stop using the Website and/or the App and may request the Data Controller to delete their personal data. Unless otherwise specified, the previous Privacy Policy shall continue to apply to the personal data collected until such moment.
